1. Agreement and eligibility
These Terms of Service ("Terms") are an agreement between you and JadeHigh Games ("JadeHigh," "we," "our," or "us"). By downloading, accessing or using our games, websites or related services (the "Services"), you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Services. You must be at least 13 years old, or the minimum digital-consent age in your country. If you are under the age of legal majority, a parent or guardian must review and agree to these Terms.
2. Limited license and ownership
Subject to these Terms, JadeHigh grants you a personal, limited, non-exclusive, non-transferable and revocable license to use the Services for non-commercial entertainment. The Services, including game code, art, characters, audio, designs, text and trademarks, are owned by JadeHigh or its licensors and protected by law.
You may not copy, sell, sublicense, distribute, modify, reverse engineer, extract assets from, create derivative works of, or commercially exploit the Services except where applicable law expressly permits it.
3. Acceptable use
You agree not to:
- cheat, automate gameplay, exploit bugs or use unauthorized third-party tools;
- interfere with servers, security, networks or another user's enjoyment of the Services;
- attempt to access non-public systems or another person's account or data;
- use the Services for illegal, harmful, fraudulent or abusive activity; or
- remove legal notices or misrepresent your affiliation with JadeHigh.
We may investigate violations and suspend or terminate access where reasonably necessary to protect the Services, users or law.
4. Purchases, virtual items and advertising
Some Services may offer in-app purchases or virtual items. Purchases are processed by the applicable app store and are subject to its payment, cancellation and refund rules. Virtual items have no real-world monetary value, are licensed rather than sold, and cannot be transferred or exchanged outside the Services unless we expressly allow it.
The Services may display advertising or links provided by third parties. We are not responsible for third-party content, products or practices. Your interactions with third parties are governed by their own terms and policies.
5. Updates, availability and termination
We may update, balance, add, remove, suspend or discontinue parts of the Services. We do not promise that every feature, item or progress state will always remain available. You may stop using the Services at any time. Provisions that by their nature should survive termination will continue to apply.
6. Disclaimers and liability
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of uninterrupted operation, accuracy or fitness for a particular purpose. We do not exclude warranties or rights that cannot legally be excluded.
To the maximum extent permitted by law, JadeHigh will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of data, profits or goodwill arising from the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid to JadeHigh for the affected Service during the prior six months or USD 50, unless applicable law requires otherwise.
7. Governing rules and disputes
These Terms are governed by applicable law without depriving you of mandatory consumer protections in your country. Before filing a claim, please contact us so we can try to resolve the issue informally. Nothing here limits rights that cannot be waived under applicable law.
8. Changes to these Terms
We may update these Terms to reflect changes to the Services or legal requirements. We will post the revised Terms and update the date above. Continuing to use the Services after an update means you accept the revised Terms where permitted by law.
